What Type of Quote Can you Request
Firstly what is the quote for? Broadly the probate process can be divided two stages.
Stage 1: Applying for a Grant of Probate or Letters of Administration.
Stage 1 is applying for the legal documentation that provides the legal right to administer the deceased persons estate. A summary of the activity is;
- Valuing the probate estate
- Securing the estate
- Calculating and Paying Inheritance Tax
- Completing the necessary probate forms and submitting them to HMRC
It sounds simple but it is a complex and time-consuming process.
Stage 2: Administering the Estate
Once the required legal documentation is granted the next stage is to administer the estate.
This involves (please note this is not an exhaustive list);
- selling or transferring any property
- liquidating assets
- selling stocks and shares of the deceased
- identifying and locating beneficiaries
- distributing the assets and finalising the estate accounts.
What should your Probate Quote Include
Whether you are asking for a quote for stage 1, stage 2 or both here are some key items that a probate quote should cover:
Probate Fees
A quote should clearly outline all fees associated with the probate process. This should include the fees for the probate professional’s services, court fees, and any other costs that may be incurred (known as disbursements).
Scope of Services
The quote should detail the specific services that will be provided, such as preparing and filing documents, managing estate assets, and communicating with beneficiaries.
Timeline
The quote should provide an estimated timeline for the completion of the probate process. This can vary depending on the complexity of the estate and the court’s schedule.
